QUESTION NUMBER ONE: According to the opinion of the RMb"M and Maran (Karo), one has to anticipate the time of the circumcision  stressing "[Be] quick prior to [in anticipation of the] miswoth", but the Yemenite tradition is to circumcise the boy an hour before the middle of the day, my question is how must [should] one act in our days [in accordance with] the law to actually do it-- whether to guard over the tradition or to be scared [fearful] for the opinion of the RMb"M and Maran?

MORI Qafahh's REPLY: In Yemen, we [I] circumcised an hour before midday, since our tradition [is] to make a meal [feast] and the time of the meal, it was an hour before midday. But today there is no tradition to make a seudah for the glory of the miswah (commandment) possible to anticipate.

QUESTION NUMBER TWO: Do all the prayers require washing with a bracha?

MORI Qafahh's REPLY: All the prayers require washing standard [as usual] with bracha (blessing) as explained in chapter wow in the laws of blessings beh.  "Whenever a person washes his hands whether before eating or before the recitation of the shma or before prayer, he should recite the following blessing---al natilath yadim. This is a Rabbinic Miswah Deut 17:11." (Mishna Tora - Hilkoth Brakhoth: chp. wow - law II)

IMPORTANT NOTE: According to the Temani Minhog, the morning Netila is also for the tefila and the Birkat Cohanim. This is a slight variation with the RMb"M.

HARD TO TRANSLATE THIS ONE:

QUESTION NUMBER THREE: Does mayim akhronim require the stipulation [of] washing ?

MORI Qafahh's REPLY: Mayim akhronim does not require the entire stipulation of washing first except there is no washing from the bottom of a well. "A blessing should not be recited before washing after eating. For this was instituted only as a protective measure. This rationale obligates a person to be more careful in the observance of the practice." (Mishna Tora - chp. wow - law II)

QUESTION NUMBER FOUR: Are soldiers required to light the Hanukah light (menorah)??

HARD TO TRANSLATE ANSWER:

MORI Qafahh's REPLY: Soldiers (servicemen) that must [be in a] special private room in a base are required to light.

-----------------------------------------------------------

QUESTION NUMBER FIVE: Is it a required foundation (according to custom) to pray during the Minha [services] of Yom Kipur [in a] whisper and repeat saying wido [confession] also in the repetition.

MORI Qafahh's REPLY: The Mahari"s(Mori harav Yehheya Ssalahh zs"l) in Minha services of Yom Kipur writes to delay (alternate translation: or delayed reporting) the custom to pray in a whisper and repeat saying Wido in the repetition. It is near our tradition of one prayer [when] reading and saying wido within shemonah asreh (the Amidahhh) .  And this fine tradition of silence was similarly known to the RMb"M because [there is] one confession in prayer.

-----------------------------------------------------------

QUESTION NUMBER SIX: What is it --[the] measure of an olive?

MORI Qafahh's REPLY: The measure of an olive is less than the bulk of 3 eggs, and all the measurements with weight are only approximate.

-----------------------------------------------------------

QUESTION NUMBER SEVEN: What is the order of washing the hands for a meal?

MORI Qafahh's REPLY: Wash hands for the meal only one time only, and the tradition of some as far as three times for a meal does not have a foundation.

-----------------------------------------------------------

QUESTION NUMBER EIGHT: What is the current obligation [regarding] wearing a talith qaton?

MORI Qafahh's REPLY: Wearing a talith qaton in today's times is a minhog of the faithful and upright (alternative trans: minhog of a Jewish Man or a Man of G-D) and one must be cautious with this.

-----------------------------------------------------------

QUESTION NUMBER NINE: Is a talith that is embroidered with verses and blessings unfit?

HARD TO TRANSLATE ANSWER:

MORI Qafahh's REPLY: A talith that is embroidered with blessings or pasukim is not unfit, but be aware that the RMb"M [considered it] a disgrace to embroider [a talith] with Bible readings because [of times when one wishes] to enter into a bathroom and and similar things.

-----------------------------------------------------------

QUESTION NUMBER TEN: Is it permissible to sanctify [say Qiddush] and to prepare before musaf but not to fix [prepare or set] a meal ?

MORI Qafahh's REPLY: It is permissible to sanctify before musaf but not to fix the meal [or prepare].

-----------------------------------------------------------

QUESTION NUMBER ELEVEN: Is the order of the ashmoroth permissible to read in sections " ?

HARD TO TRANSLATE ANSWER:

-----------------------------------------------------------

QUESTION NUMBER TWELVE: Are soldiers that finish with military service required to say the birkath haJomayl (blessing on deliverance from danger) ?

HARD TO TRANSLATE ANSWER:

MORI Qafahh's REPLY: Soldiers that finish are not required to bless Joymayl only four blessings the sages assigned.

-----------------------------------------------------------

QUESTION NUMBER THIRTEEN: Regarding residents with nausea [defilement?], is one able to sit to bless /and utter duties/ with the rest with the blessing nodding (saying yes) like the way we do with the blessing of bread.    ?

MORI Qafahh's REPLY: If the one who blesses for everyone is nauseas, there is a dispute (difference of opinion) between the RMb"M and the Ravad, in Yemen our tradition is that each one who blesses in a loud voice and everyone answers Amen.
